Piracy is a service delivery failure

While it won't stop everyone, if that game were freely available I'm sure there would be several less folks emulating them right now

Emulate the old games. Unlike the original SMAS, 3d All-Stars added nothing to the experience that can't be done with emulation. I say this as someone who bought it.

I remember hearing from many people, "I wasn't going to buy it, but it's only available for a limited period, don't want to miss out on it".

I voted with my wallet, and didn't buy it. I lost the vote though, since it sold pretty well.

Which explains why they did it. They created some hype, and earned some money, and still kept it for making some quick money by remaster / re-release when needed.

I mean the first sentence answered the question. It was available for a limited time due to 35th anniversary. It’s a dumb reason but the answer is right there.

It's a rhetorical non-answer, "the 35th anniversary release was only available for a limited time because it was only available for a limited time".

There are hundreds of anniversary releases of games that are made permanently available - hence why people asked Nintendo why this one was given an artificially short availability so often that it became an FAQ question. They own the rights, they can sell it indefinitely if they want.

Eg: search Steam for 'anniversary' you'll find 600+ results.

It's in the first three words of the article. It's celebrating the anniversary, so you buy it during the anniversary period. How long do you celebrate your birthday for? If you got a birthday present to celebrate your 35th birthday six months after you turned 50, is it still a 35th birthday present?
