New York could soon start to get more recreational marijuana dispensaries after a judge on Friday approved legal settlements to end lawsuits that halted the state’s legal cannabis licensing program.

The settlements lift a court order that has blocked the state from processing or issuing retail marijuana licenses since August. State officials said the agreement will allow more than 400 potential retailers to move forward with pending applications to open storefronts.

“With this settlement behind us, hundreds of new licenses can now move forward, new stores will open, and consumers can legally buy safer, legal, tested cannabis products from New York-based entrepreneurs and small businesses,” Gov. Kathy Hochul said in a statement.

It's so stupid.

Indiana is surrounded by states with either legal medical or recreational weed. Everyone who can, including me, goes to Illinois, Michigan or Ohio to get weed. The place in Illinois I go to has a 20% discount card for all purchases, basically negating the taxes for me. The only thing I don't like is that I'm limited to 14 grams because I'm from out of state. It's still illegal in Indiana, but Delta-8 and Delta-10 are legal. It's such a farce. I live in Terre Haute and there's probably two dozen vape, CBD and Delta-8/10 shops here which are just waiting for weed to be legal.

It's my understanding that Biden can't legalize it federally, but he can reschedule it so it isn't scheduled on the same level as heroin and meth. It's ridiculous that he hasn't done so.

[–] [email protected] 9 points 1 year ago (1 children)

That certainly sucks.

With regard to the scheduling, to be fair to Biden, there is a set process in which the final scheduling is determined by the DEA. This process goes back to the Controlled Substance Act of 1970 (when a lot of our stances on drugs became fucked up).

https://www.dea.gov/drug-information/csa

Biden has called on Cannabis scheduling to be reexamined, now HHS has done their internal study and they think it should be stopped to a lower schedule, and now it's the DEAs turn to act on their recommendation or not. (They are expected to, but who in the hell knows.)

It could be argued that maybe Biden could do it with an executive order, but they're probably not going to do something that can be seen as circumventing the administrative process (since Republicans are more than happy to tear all of these agencies down, or at least they say they are.) EOs are pretty fragile things too.

The only other option in that case would be for Congress to pass or amend a law legalizing Cannabis and/or reforming the CSA. But Congress are pretty damn unreliable to say the least.

Thanks for clarifying. I didn't realize it was that complicated.

[–] [email protected] 9 points 1 year ago

It really shouldn't be... And personally I think it makes zero sense for the DEA to both schedule substances and police them, because it creates an obvious conflict of interest that got us here in the first place. But here we are.

I'm fairly certain only Congress can resechedule Marijuana - it was explicitly listed as Schedule 1 in the Controlled Substances Act. A President could try ordering the DEA to reschedule it, but it would end up before SCOTUS.

There's another loophole in play already. Look into high THC-A hemp (/r/cultofFranklin). THC-A turns into THC with heat. These vendors sell "hemp" that's below the legal limit in THC but like 20% THC-A. It gets shipped through USPS, it's cheap, natural, and currently legal in most states. Sometimes the quality is not quite as good as dispensary and I'm sure the dispensary has stronger stuff. But this stuff gets me stoned, it's not just a little buzz.

[–] [email protected] 4 points 1 year ago (1 children)

Sounds odd because that’s how regular weed works. It is created as THCa in the plant and then turns to THC with decarboxylation.

[–] PainInTheAES 1 points 1 year ago

Yeah but I think the high THCa hemp being sold is using high THCa strains or harvesting earlier. IIRC the more the plant matures the more THCa turns into THC. The law is currently only testing for THC content not total cannabinoid connect but that may end up changing at some point.

[–] FlyingSquid 1 points 1 year ago (1 children)

Why should I do that when I can just take a quick trip to Illinois and buy real weed from a dispensary where I can pre-order and the online menu tells me exactly how much THC and CBD each product has and have a friendly experience at the same time?

Both of the dispensaries I have been to in Illinois have been really pleasant experiences. Everyone was very nice and friendly, which you can't say for too many businesses these days. I find that alone worth going for because it's so amazingly refreshing.

[–] PainInTheAES 1 points 1 year ago (1 children)

Because those vendors also have an online store front and labs with THC and CBD breakdown, it's cheaper, there's no purchase limit, and shipped to your house. IDK about you but I'd rather sit at home than drive to another state. Also not everyone live near a legal state and/or wants to take the risk when driving back home.

[–] FlyingSquid 1 points 1 year ago

I can certainly see the benefits if it's a long drive or you don't live near a legal state, but it's a quick trip up the interstate for me, I like supporting a small, essentially local, business, and, as I said, it's a pleasant experience in a world with so few pleasant experiences, so I enjoy taking advantage of it.

How does the delta 8/10 stuff compare to the real thing? I'm unfortunately unable to use any of them due to a federal job that does random testing.

[–] Witchfire 2 points 1 year ago* (last edited 1 year ago)

The doses are very different. Delta 8 is weaker, so my rule of thumb is that you need to take about 2.5x your normal dose (25mg delta 8 ~= 10mg delta 9). It feels like THC mixed with CBD.

That said, it also makes me feel groggy and like shit afterwards. I hate the stuff. I don't trust it.

No idea on Delta 10, but I generally don't trust any recreational drug that is made in a lab

[–] FlyingSquid -1 points 1 year ago

No idea. I don't trust them.

Motha fuckin Indiana. Armpit of the Midwest.

It's cheapest in Michigan, if you can get there. The drive is closer for me anyway.

[–] FlyingSquid 2 points 1 year ago (1 children)

I'm like 4 hours from Michigan but right on the Illinois border.

[–] [email protected] 2 points 1 year ago

Oh yeah, definitely too far just for a trip for supplies then.
