In the US the cops would weigh the entire plant, soil and all and charge based on that weight. Friend got busted and thrown in jail for a bunch of seedlings because they weight the entire pot as weed. Don't trust cops kids.

I can't speak for where I live now, but back in Texas making brownies would get you fucked over.

Not only would they weigh the entire brownie (regardless of how much was used to make it), they'd weigh it in the baking dish. To top it off, since it was "processed" it was seen as a further aggravating cause.

The other guy thinks reason will prevent over reach but in my experience prosecutors frequently charge outside the law and it's on you to defend yourself. Growing just for yourself is typically booked as growing for the purpose of illicit sales, much more serious charge and they don't have to prove it.

If you can afford an attorney sure you can fight it. Costs thousands of dollars. He paid at least $15k to get his case overturned. This is after spending a few days in jail and 2 years of court procedures. They expect you to just plea bargain and take a lesser charge and not fight it.

Not all states are equal. Court appointed lawyers tend to push plea bargains on you. If you want to get the charges expunged you need a professional that works specifically with those cases. That's what he did.

There’s still something off about the story. That would be a slamdunk case that any lawyer would take probono.

The cops weigh the plant wet, but when it dries you lose up to 80% of the weight, not mention stems. With a single flowering plant, that’s usually enough for anything to stick.

So you buddy MUST have had something else if they got weighing the soil or plugs with it to stick. They’re scum, but there’s also policies to follow too.
