IDK. I think there's an argument either way. Boneless wings are clearly intended to be deboned, but they are also intended to be relatively minimally processed. I don't think the presence of bones is near as unexpected as it would be in a chicken nugget, for example. I've definitely had small bones in boneless wings plenty of times, and I think processing them to the level that you could provide a guarantee that there are no bones would significantly lower the "wing-ness" of the wings. I don't really think the occasional bit of bone or similar gristle is the product of negligence.
But choking on a chicken bone would suck.
