Pewdiepie is a piece of shit and may be way more so, but it absolutely is irrelevant for the case of abusing DMCA system. They can adjust their stance, they can say "we are fine with everyone but pdp streaming and letsplaying our game", but it's absolutely not OK to first allow that and afterwards issue DMCA
Would it not be possible for the IP holder to stipulate via contract or EULA "You are only allowed to broadcast our IP if you follow these guidelines". Then if the streamer breaches that contract they no longer have rights to broadcast that IP. And if they don't remove that content willingly, a DMCA takedown seems like the proper course of action.
I'm not anything resembling a lawyer, just playing devils advocate.
