Legal situation, currently, is that any cannabis plant tissue that tests below the thc marker is legally hemp.
Meaning any seed and veg clone of a cannabis species is, legally, a hemp plant, until it flowers and begins to produce thc.
It is a similar loophole that mushroom growers have, where spores of psilocybin-producing fungi technically do not yet have psilocybin in them, and thus are legal to own and sell.
As I understand it, this is the federal stance in the US for cannabis, as I know official licensed farms who are legally selling "hemp" clones of known weed strains across state lines. Please double check your laws before taking this as gospel, as I dont actually directly deal with sales so I dont need to know the strict legal details.
