In a decision dated July 26, the Indiana Department of Education determined that Clay shall be made available for lease or purchase by a charter school system for $1.

The SBCSC claimed to be exempt from the dollar law because it had formed a partnership and agreed to share funds from its 2020 referendum with a different charter school — Purdue Polytechnic. While there was a time when such a move would have made a difference, that time has passed. The law changed to read that no resolutions, referendums, or distributed revenue prior to May 10, 2023, are effective to provide exemption.

The state concludes the SBCSC shall make Clay available for lease or purchase.

The SBCSC plans to appeal the determination to the State Board of Education.
