I don't think they can call it rape until after she's been convicted of rape, unless they want to open themselves up to a lawsuit. Not sure if they could have said, "Allegedly raped," or not, but I wouldn't fault the writer or even the publisher for having to phrase it this way. I think their choice of headline was more likely motivated by legal pressures than any sort of bias against rape victims, male or female.
From what I've heard it's not legally advisable in most countries for media to lable things as rape prior to the perpetrator being convicted of rape. Also I think the law commonly defines rape as forceful penetration, at least in the US. So it's not necessarily the writer's/publisher's fault when the headlines don't call it what it is.
