“The city’s taxpayers should not be responsible for the damage caused by the Stough Development Group’s failure to maintain its property in a safe and reasonable manner,” the city alleged in the lawsuit. “[T]he city’s infrastructure was damaged and public transportation and access to Main Street was impeded.”
